Non implementation of ceasefire agreement.
Many of the obligations of the Ceasefire Agreement between the Srilankan Government and the Liberation Tigers of Tamil Eelam signed on 23February 2002, have not been implemented by the Sri Lankan Government. The people had justifiable expectations that the current peace process will focus its attention to the urgent and immediate needs of the people of North East, particularly that of the thousands of people languishing in the welfare centers and refugees' camps. Hence, a provision was included in the ceasefire agreement that in order to restore the normalcy the forces should vacate the houses of the Tamil people, schools, places of worship and public buildings. Jaffna District As far as Jaffna District is concerned the security forces are still in occupation of 144.15sq.km area. In this area 30,388 families were living earlier. Out of this 24,178 families are still unable to resettle in this area which includes 67 G.S. divisions and also 246 places of worship and 47 schools. Further, 81.5sq.km sea area is out of the bounds for the fishermen and 12,259 acres of land cannot be used for agriculture. 16,027 farming families and fishing families are not in a position to pursue their profession. As 40,000 security forces have been occupying houses belonging to the public agricultural land and public buildings it has very severely affected normalcy. These people have been denied the freedom of access to their houses and property. The relevant section of the ceasefire agreement clearly defines that in order to enable people to continue their normal life both parties should vacate their camps from residential areas. Vavuniya District There was a reasonable expectation in the minds of the Tamil people of the Vavuniya District that the sad tale of many a thousands people languishing in the welfare centers and refugees' camps would come to an end as they thought the peace process will address to the urgent and immediate needs for the survival of these hapless lot. They also believed that having this in consideration only, a clause was introduced in the CFA that forces should vacate from the residences of the Tamil people, schools and public buildings. But as far as Vavuniya district is concerned a high security zone consisting of 16 G.S. divisions and 49 villages is still there intact. There were 4287 families, consisting of 18207, members were living in this area. But now only 1173 families, consisting of 4729 people, are living in this area. The section 2.3 of the CFA says that the process of releasing the schools and the public buildings shall commence on the date the CFA coming in to force and shall be completed within 160 days. Whereas the security forces are still in occupation 30 public buildings and 24 schools in 16 G.S. divisions of the Vavuniya district. The schools and other institutions functioning in those building are now unable to function. In the Vavuniya district the army has occupied the residences and land of 111 families, thus preventing their resettlement there. Further, in the 16 G.S. divisions of the HSZ, land belonging to 45 individuals and houses belonging to 46 families have been occupied by the army under the guise of HSZs. This prevents the restoration of normalcy and mobility. The army positions in these areas preclude people from getting information about their damaged houses and the situation about some villages as a whole, for example villages like Semamadu, Panrikeithakulam, Papamoddai and Kalmadu. Most of the families in the Vavuniya district are farming families. But their farm land, drainage and tanks are within the army camp area and therefore, the people cannot pursue land cultivation and thus their livelihood. A total of 1160 farmers are not in a position to cultivate 5700.15 acres of land and at the same time 58 tanks cannot be used for agriculture and other purposes. On the whole the people in the Vavuniya district aren't permitted to resettle in their own land and continue cultivation as the security forces are in occupation of their land, places of worship , schools and public buildings under the guise of HSZ. Mannar District The section 2.3 of the CFA says that the security forces should vacate the schools, public buildings and residence within 160 days from signing of the agreement. However, when one looks at the position after 500 days of signing the CFA. The Police is in occupation of 15 public buildings, 4 coconut plantation lands, land belonging to two individuals, two temples and 91 houses totaling 114 places. The Sri Lankan army is in occupation of 17 public buildings, 5 school buildings, 2 temples and 52 houses totaling 76 places. The Sri Lankan Navy is occupying 8 public buildings, 11 houses, 2 coconut plantation lands and 2 Palmyra plantation lands totaling 23 places. In other words, even after 500 days of the CFA the security forces are in occupation of 154 houses belonging to the public, 6 coconut estates, 40 public buildings, 4 places of worships, 5 school buildings, 2 Palmyra land totaling 213 places. This clearly indicates how the freedom of living in their own houses has been denied to the people and also how the normal life of the people is affected. The section 2.11 says that all restrictions placed on the fisherman will be removed enabling the fisherman to do fishing day and night. But even now there is harassment of fishermen, pass system, curtailed fishing hours, aggressive actions of Indian fishermen such as seizing and damaging boats, nets etc. prevailing. Therefore, it is certainly a matter of grave concern that no meaningful action has been taken to vacate the forces from places where people live in concentration and restore normalcy for the people.
