Appeal to EU Presidency for action on Sri Lanka: Christmas Eve murder in the cathedral of Tamil Member of Parliament and human rights activist

It is with great sadness that we bring to your attention the killing of a Tamil Legislator and human rights advocate Mr. Joseph Pararajasingham who was shot dead on December 24th, while attending midnight Christmas mass in Batticaloa Cathedral in the High Security zone of Sri Lanka. Mr.Pararajasingam’s wife and seven others were critically wounded when they tried to protect him from the bullets.
Mr. Pararajasingham is the second member of the Northeast Secretariat on Human Rights (NESOHR) to be killed this year. NESOHR member Mr. A ChadraNehru was shot also dead in February 2005.
In his parliamentarian life, Mr. Pararajasingam, documented multiple human rights violations in eastern Sri Lanka during the 1990’s. As evidenced by the Sri Lankan parliament “Hansard”, he persistently challenged the Sri Lankan government on its human rights record. He traveled internationally as the leader of the Tamil National Alliance foreign relations committee, representing the Tamils, to bring the human rights situation in Northeast to the attention of the International community.
His latest challenge was on last Tuesday in the parliament with his TNA colleagues demanding the withdrawal of the occupying army from the North East because of the Sri Lankan army’s brutal attack on university students, Deans and lecturers who were peacefully protesting the rape and murder of young Tamil girl Tharshini in Pungudutheivu. He was a true democrat and human rights defender. It is widely believed that the gun used to silence the voice of this noble man is belonged to the government-backed paramilitary in the East.
The European Union under the presidency of Britain has been silent on the systematic intimidation of the Tamils by the Sri Lankan military apparatus this year except lip services to the government of Sri Lanka. It has failed to take steps to prevent attacks on leading Tamil civil rights activists, members of parliament, senior journalists, universities students, lecturers and other citizens by the Sri Lankan armed forces, intelligence services and paramilitaries in their control.

“States that want to oppress a people do so by breaking the political will to resist injustice. To do this, oppressing states kill society’s intellectuals and journalists who speak for the rights of their people. They want Tamils to be intellectually rudderless. It is easier to enslave a people who have lost their ability understand the nature of their oppression.” This was spoken at the memorial meeting for the slain Batticaloa Journalist Aiyathurai Nadeson on 7th august 2004, by late Dharmaratnam Sivaram who too was shot dead in the capital city of Colombo on 28th of April 2005

The followings are evidences that the Repressive regime seeks to intimidate in a number of well-understood ways. Below are some methods in which the Sri Lankan armed forces and military intelligence have intimidated the Tamil people of Sri Lanka:

1.Extra judicial killing of civil rights activists, thought leaders and persons involved in international advocacy:
a.Mr. Joseph Pararajasingham, TNA Member of Parliament, was killed in army-controlled territory allegedly by military intelligence and paramilitaries controlled by them. This highlights the risks to the lives of all Tamil parliamentarians who have traveled internationally to advocate Tamil rights. Family members of other members of parliament have been killed in the past by the Sri Lankan intelligence services – e.g. Mr. Kumar Ponnambalam a leading human rights lawyer was shot in Colombo in 2001 allegedly by Sri Lankan military intelligence.
b.Mr. Gajendran, TNA Member of Parliament for Jaffna was assaulted and seriously injured by the Sri Lankan army earlier this week.
c.Mr. Joseph Pararajasingham is the second member of the NESOHR to be killed this year.
2.Intimidation and killing of journalists: Sivaram Dharmeratnam, editor of Tamilnet (www.tamilnet.com) was abducted and shot in a high security military zone in Colombo earlier this year. Every one of the four major newspapers in Jaffna has been intimidated in December, journalists arrested and a newspaper worker shot outside the paper’s offices in Jaffna. 3.Intimidation and killing of intellectuals, students and academic faculty. Systematic intimidation of the faculty and students of the University of Jaffna in the last week alone is detailed below.

Mr. K. Navaratnam (47), Jaffna district organizer for Tamil Resurgence celebrations was shot dead. Previously Kopay organizer for the Tamil Resurgence celebrations and Principal of Kopay Christian College, Mr. Sivakadadcham, was shot dead on 11 October by gunmen alleged to be belonging to Sri Lanka Army intelligence.

Jaffna University Vice chancellor tells the press that the new military top brass in Jaffna are responsible for attack on the university, its students and faculty.

The body of 20 year old Ilayathambi Tharsini, who had been raped and murdered, after being abducted allegedly by Sri Lankan Navy personnel, was found in an abandoned well near the Sri Lanka Navy camp Friday, sources from Jaffna said. This rape by military personnel took place in army-controlled territory in an internal conflict is a war crime.

It is clear that this month shows familiar patterns of intimidation, arbitrary arrests and execution, arson, torture, rape and murder. We are haunted by the events of the 1990s; the broad front and aerial attacks on Tamil civilians by the Sri Lankan army, the disappearances and systematic intimidation of an entire ethnic population. We recall that the international community did nothing then constructively to protect the Tamils and many Tamils sought asylum in Europe and other countries. Though the civilians are resisting but they cannot fight the might of the Sri Lankan military machine.

We trust that this time the international community be different and will take immediate steps with the genuine intention of protecting the civil rights, fundamental freedoms and security of the Tamils of Sri Lanka and also will protect the Tamil legislators who are engaged in service to their constituents and international advocacy for restoration of their rights and fundamental freedom of the Tamil people of Sri Lanka.

Secondly, Civil Society under army occupation in the North and East have the right to protest against any violence committed against any member of their community peacefully and therefore the Sri Lankan Security forces must be ordered to stay away and allow the civil society to conduct their peaceful protest to express their concerns in public without intimidation or threat of murder by the armed State forces.

Thirdly, we also appeal to your good offices to prevail upon the Sri Lankan government that the Sri Lankan army vacates their position from Tamil civilian areas, schools, universities, stop harassing civilians, demonstrates their work of disarming the paramilitary groups genuinely and cease to use these groups to provoke the LTTE.

Finally, we appeal to you to bring both parties, Sri Lankan Government and the LTTE to the negotiating table in Europe because security, transparency and parity of status during their dialogue can only be achieved in Europe than any other countries and also it is home to a majority of the Tamil Diaspora.
Failing the above, the international community must now show enough political and moral courage to recognize the right to self-determination of the Tamil people in order to restore their sovereignty and organize their political future in the Island to co-exist with the rest of the population in harmony without further blood shed.
